SPX Website – Terms and Conditions
These Terms and Conditions ("Terms") govern your use of the SPX website ("Website") and the purchase of products offered by SPX ("we", "us", "our"). By accessing or using the Website, you agree to be bound by these Terms.
1. Products
1.1 Product Descriptions
We make every effort to ensure that product descriptions, images, specifications, and pricing are accurate. However, minor variations may occur. Colours shown on-screen may differ from actual colours due to display settings.
1.2 Availability
All products are offered subject to availability. If an item is out of stock or unavailable after an order is placed, we will contact you to provide an alternative option or a refund.
1.3 Pricing
Prices are listed in Australian dollars (AUD) and include GST unless otherwise stated. We reserve the right to change prices at any time without notice.
2. Orders
- 2.1 Order Acceptance: Submitting an order does not constitute acceptance. An order is accepted once payment is received and we issue an order confirmation.
- 2.2 Refusal or Cancellation: We reserve the right to refuse or cancel any order due to suspected fraud, incorrect pricing, product unavailability, or breaches of these Terms.
3. Payment
We accept payment via the methods listed on the Website. By completing a purchase, you warrant that the provided payment information is accurate and authorised.
4. Delivery
4.1 Delivery Areas
We deliver products within Australia. International delivery may be available upon request.
4.2 Delivery Timeframes
Estimated delivery times are provided as a guide only. Actual delivery times may vary due to courier delays, stock levels, or external factors.
4.3 Delivery Charges
Shipping costs are displayed at checkout and depend on order size, weight, and delivery location.
4.4 Risk and Title
Risk in the products passes to you upon delivery. Title passes once full payment is received.
4.5 Dispatch
We aim to pack and dispatch all orders within 24 business hours of receiving them (Monday to Friday, excluding public holidays) from our warehouse in Heidelberg West, Victoria. Please note that dispatch times may vary during peak trading periods, including Christmas, major sales events, and public holiday periods, when order volumes are significantly higher.
4.6 Shipping Carriers
To provide the best balance of value and delivery speed, we ship using both Australia Post and CouriersPlease, selecting the carrier that offers the most suitable service for your order.
4.7 Delivery Disclaimer
Once your order has been dispatched and leaves our warehouse, it is in the hands of the shipping carrier. While we work with trusted delivery partners, shipping timeframes provided at checkout are estimates only, and occasional delays may occur due to circumstances beyond our control.
If your order has not arrived within the estimated delivery timeframe, please don't hesitate to contact our team. We will gladly follow up with the relevant fulfilment and delivery partners to investigate the delay and provide you with an update.
5. Returns and Refunds
5.1 Faulty or Damaged Items
If you receive a faulty, defective, or damaged product, contact us within 7 days of delivery with proof of purchase and photos of the issue. We will repair, replace, or refund in accordance with Australian Consumer Law. 5.2 Change of Mind Returns
We do no accept change of mind returns under any circumstances.
6. Warranty
Products may include manufacturer warranties. These warranties do not cover misuse, improper installation, or normal wear.
7. Website Use
- 7.1 Intellectual Property: All content on the Website is the property of SPX Abrasives (SPX Abrasives) or its licensors. You may not reproduce, distribute, or modify any content without permission.
- 7.2 Prohibited Use: You must not use the Website for unlawful purposes, to transmit harmful code, or to interfere with Website functionality.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of our products or Website.
Nothing in these Terms excludes rights guaranteed under Australian Consumer Law.
9. Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, store, and disclose personal information.
10. Affiliate Program
Each affiliate agrees to comply with these Terms and Conditions, as well as any additional terms, policies, commission arrangements, promotional requirements, or other conditions specified in their affiliate profile or communicated by SPX Abrasives.
SPX Abrasives may, at its absolute discretion, suspend or terminate any affiliate account or cancel an affiliate's participation in the program at any time, with or without notice, if SPX Abrasives considers it appropriate to do so.
11. Display Stands & Stock Ownership
All display stands supplied by SPX Abrasives remain the property of SPX Abrasives at all times. SPX Abrasives reserves the right to remove, relocate, or request the return of any display stand from a wholesale customer at its sole discretion and at any time, with or without notice.
Display stands are to be used solely for the promotion and display of SPX Abrasives products. The wholesale customer must not display, store, or promote any third-party or non-SPX products on or within the display stand without prior written consent from SPX Abrasives.
All products supplied for use within display stands remain the property of SPX Abrasives unless:
- the wholesale customer has purchased the products upfront; or
- a separate written agreement has been made between SPX Abrasives and the wholesale customer confirming alternative ownership arrangements.
Where products remain the property of SPX Abrasives, the wholesale customer is authorised to sell these products in the ordinary course of business. Upon sale, ownership of the individual product transfers to the end customer.
The wholesale customer agrees to:
- take reasonable care of the display stand and any unsold products;
- not transfer or dispose of unsold products outside of normal retail sale without prior approval from SPX Abrasives; and
- make any unsold products and display stands available for collection upon request.
12. Changes to Terms
We may update these Terms at any time. The updated version will be posted on the Website with the effective date.
